3. Hardware and Equipment

If you purchase or lease hardware from us, you agree to use it only in accordance with our documentation and instructions. You are responsible for maintaining the hardware in good working condition and for ensuring that it is used in a safe and secure environment.

Title to leased hardware remains with GameVision. You agree to return leased hardware to us upon termination of your subscription in the same condition as when delivered to you, reasonable wear and tear excepted.

4. Data and Privacy

Our Privacy Policy, available at gamevision.com/privacy, describes how we collect, use, and share information about you when you use our Services. By using our Services, you agree to our collection, use, and sharing of information as described in our Privacy Policy.

You represent and warrant that you have all necessary rights, licenses, and permissions to provide any data that you upload to or process through our Services, and that your use of our Services will not violate any third-party rights or any applicable laws or regulations.

5. Intellectual Property

The Services and all content and materials included on or in the Services, including text, graphics, logos, images, and software, are the property of GameVision or our licensors and are protected by copyright, trademark, and other intellectual property laws.

We welcome feedback, comments, and suggestions for improvements to the Services. You grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and distribute any feedback, comments, or suggestions you provide to us.

6. Payment Terms

For subscription services, you authorize us to charge your payment method on a recurring basis. If your payment method fails or your account is past due, we may suspend or terminate your access to the Services.

You may terminate these Terms at any time by canceling your account and discontinuing use of the Services. We may terminate or suspend your access to the Services at any time, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

IN NO EVENT WILL GAMEVISION, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10. Indemnification

You agree to defend, indemnify, and hold harmless GameVision, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

11. Governing Law and Jurisdiction

These Terms and any disputes arising out of or related to these Terms or the Services will be governed by the laws of the State of Nevada, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or the Services will be brought exclusively in the federal or state courts located in Clark County, Nevada.

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website prior to the changes becoming effective. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.
